Throughout this Website, the terms "we", "us", and "our" refer to SimplyGods Global Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN [U10304CT2025PTC018774], with its registered office at PLOT NO F-23, WARD NO-63, ASHISH NAGAR, WEST RISALI, Civic Centre Bhilai, Durg, Durg- 490006, Chhattisgarh
(which expression shall, unless repugnant to the context, include its successors and permitted assigns).
We offer this website, including all information, content, and functionality available on it, and the food and beverage products listed for sale on it (the "Products"), to you, the user, conditioned on your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our Website and/or purchasing any Product listed on it, you agree to be bound by the following terms and conditions ("Terms"), including any additional terms, conditions, and policies referenced herein or made available by hyperlink, including our Returns and Refunds Policy and Privacy Policy.
These Terms apply to all users of the Website, including without limitation browsers, customers, and contributors of content. Please read these Terms carefully before using the Website. If you do not agree to all the terms and conditions of these Terms, you may not access the Website, purchase any Product, or place an order.
Any new features or functionality added to the Website shall also be subject to these Terms. You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our Website; it is your responsibility to check this page periodically for changes.
2. General Conditions
2.1 We reserve the right to refuse to accept or fulfil any order, or to restrict access to the Website, for anyone, for any reason, at any time.
2.2 You understand that your content (excluding payment information) may be transferred unencrypted and involve transmissions over various networks, and adaptations to conform to technical requirements of connecting networks or devices.
2.3 You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website, its content, or access to it, without our express written permission.
3. Products, Pricing and Availability
3.1 Certain products may be available exclusively online through the Website and may be limited in quantity, and are subject to return or exchange only in accordance with our Returns and Refunds Policy (Section 10).
3.2 SimplyGods products are clean-label, whole-food formulations manufactured without artificial emulsifiers or additives, and are FSSAI certified (11526998000103). Because our products are made from natural, whole-food ingredients, minor batch-to-batch variation in colour, texture, or appearance is normal and does not constitute a defect.
3.3 We have made every effort to display the colours and images of our products as accurately as possible on the Website. We cannot guarantee that your device's display will render colour with complete accuracy.
3.4 We reserve the right, but are not obligated, to limit the sale of our Products to any person, geographic region, or jurisdiction, and may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any Product that we offer, and may discontinue any Product at any time at our discretion.
3.5 Certain products may be sold on a Pre-Order basis, meaning they are not yet in immediate dispatch-ready stock. The expected dispatch window will be stated on the product page and at checkout, and is an estimate, not a guaranteed delivery date.
3.6 All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise at checkout. We reserve the right at any time to modify prices for our products, without notice, without affecting orders already confirmed.
4. Accuracy of Order and Account Information
4.1 You agree to provide current, complete, and accurate purchase and account information for all orders placed through the Website, and to promptly update your account and other information, including your email address and delivery address, so that we can complete your order and contact you as needed.
4.2 For more detail on how order and payment information is handled, please review our Privacy Policy. SimplyGods is not liable for orders delayed or misdelivered as a result of incorrect information provided by you.
5. Payment and Billing
5.1 The amount due and payable by you for a transaction will be presented before you place your order. All payments are processed through third-party, RBI-authorised payment gateway(s) [Razorpay]. We do not store your card, UPI, or net-banking credentials.
5.2 If you choose to initiate a transaction, you consent and authorise us to share your payment information with our third-party payment processor for completion of the transaction, and you agree to: (a) pay all applicable fees and taxes; (b) bear any additional costs or charges your bank or financial service provider may levy in relation to the transaction; and (c) permit verification, pre-authorisation, and payment processing checks as required.
5.3 You will receive a confirmation email or SMS once payment for your order is confirmed. Your order is not binding on us until it is accepted and confirmed by us in this manner.
5.4 All payments made are non-refundable and non-transferable except as expressly provided under Section 10 of these Terms.
5.5 In the event of a failed transaction where an amount has been debited from your account but the order was not confirmed, such amount is typically auto-reversed by your bank or payment provider within 5–7 Business Days. If it is not, please contact us with your transaction reference ID.
5.6 We reserve the right to refuse or cancel any order suspected of fraudulent, unauthorised, or duplicate payment activity, and to cancel orders arising from pricing or listing errors, with a full refund of any amount paid.
6. Shipping, Delivery and Cancellation
6.1 We currently ship within India only, to serviceable pin codes displayed at checkout. Estimated delivery timelines commence from the date of dispatch, not the date of order, and are estimates that may be affected by courier delays, weather, regional restrictions, or force majeure events (Section 14).
6.2 Shipping charges, if applicable, are displayed at checkout before payment. Risk of loss and title to products pass to you upon delivery to the address provided at checkout; it is your responsibility to inspect the package upon receipt.
6.3 You may cancel an order free of charge at any time before it has been dispatched, by writing to [wecare@simplygods.in]. Once an order has been dispatched or handed to our courier partner, it cannot be cancelled.
7. Third-Party Tools and Links
7.1 We may provide access to third-party tools (including our payment gateway, courier partners, and analytics providers) over which we neither monitor nor have control. Such tools are provided "as is" and "as available", without warranties of any kind, and any use of them is entirely at your own risk.
7.2 The Website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any linked third-party website, and inclusion of a link does not imply endorsement.
8. User Comments, Feedback and Submissions
8.1 If, at our request, you send certain submissions (for example, product reviews or feedback), or if without a request from us you submit content, you agree that we may, at any time, edit, copy, publish, distribute, or otherwise use such content across any media, without restriction.
8.2 You agree that your comments will not violate any right of a third party, including copyright, trademark, privacy, or any other personal or proprietary right, and will not contain unlawful, abusive, or otherwise objectionable material. You are solely responsible for any comments you make and their accuracy; we take no responsibility for comments posted by you or any third party.
9. Prohibited Uses
In addition to other prohibitions set out in these Terms, you are prohibited from using the Website or its content:
For any unlawful purpose, or to solicit others to perform or participate in any unlawful act.
To violate any applicable international, national, or state regulation or law, including Indian food-safety and consumer-protection law.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate.
To submit false or misleading information, or to interfere with or circumvent the security features of the Website.
To resell products purchased from the Website for commercial purposes without our prior written authorisation.
We reserve the right to terminate your access to the Website or any order for violating any of the prohibited uses.
10. Returns and Refunds Policy
Because SimplyGods sells consumable food products, this policy is narrower than typical e-commerce return categories, in line with food-safety norms.
10.1 You may raise a refund request within 48 hours of delivery if: (a) the package arrives damaged, tampered, leaking, or with a broken safety seal; (b) you receive the wrong product, flavour, or quantity; (c) an item is missing from your order as per the Order Confirmation; or (d) the product received is expired or has a manufacturing defect materially affecting quality or safety.
10.2 To raise a request, email wecare@simplygods.in or WhatsApp 8655981209 with your Order ID, a clear photo or short video of the product and packaging (including the batch/expiry code), and a description of the issue. An unboxing video is strongly recommended and may be required for claims of missing items or transit damage.
10.3 Returns are not accepted for: change of mind, taste preference, or dissatisfaction after a pack has been opened or consumed; minor, expected variation in colour, texture, or appearance between batches arising from our natural, emulsifier-free formulation (Section 3.2); requests raised more than 48 hours after the delivery timestamp recorded by the courier partner; or products without original packaging or batch code, or showing signs of misuse or improper storage after delivery.
10.4 We will review each request and respond within 5 Business Days with an approval, rejection with reason, or a request for further evidence. Approved cases are resolved, at our discretion, by (a) replacement of the affected item(s) in the next available dispatch, or (b) a full refund of the value of the affected item(s), including original shipping charges where the fault is ours.
10.5 Refunds are issued only to the original payment method used for the transaction; we do not issue cash refunds. Once approved, refunds are initiated within 3 Business Days and will reflect in your account within 5–9 Business Days thereafter, depending on your bank or payment provider.
10.6 No return or pickup fee is charged to you for an approved return. If any courier partner asks you to pay a fee for pickup or delivery of a replacement, please do not pay it and report it to us immediately.
10.7 Cancelled orders (Section 6.3) and orders cancelled by us (Section 5.6) are refunded in full within the same 5–9 Business Day window referred to in Section 10.5, with no deduction.
11. Health, Allergen and Nutritional Disclaimer
11.1 SimplyGods products are food items intended to supplement a balanced diet. They are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical or dietary advice.
11.2 Please read the ingredient list and allergen declaration on the pack before consumption. If you have a food allergy, intolerance, medical condition, or are pregnant or nursing, consult a qualified physician or nutritionist before consuming any product.
12. Intellectual Property
All content on the Website — including the SimplyGods name, logo, tagline "For mortals who move like gods", product formulations, packaging design, photographs, graphics, and text — is the exclusive property of SimplyGods Global Private Limited or its licensors and is protected under Indian copyright, trademark, and design law. You may not reproduce, copy, distribute, or create derivative works from any part of the Website without our prior written consent.
13. Disclaimer of Warranties; Limitation of Liability
WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED UNDER APPLICABLE INDIAN LAW (INCLUDING THE FOOD SAFETY AND STANDARDS ACT, 2006 AND THE CONSUMER PROTECTION ACT, 2019), THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO ITS OPERATION. NOTHING IN THIS SECTION LIMITS ANY STATUTORY WARRANTY OR GUARANTEE ATTACHING TO THE PRODUCTS THEMSELVES UNDER APPLICABLE CONSUMER PROTECTION AND FOOD SAFETY LAW.
13.1 In no case shall SimplyGods, our directors, officers, employees, affiliates, or agents be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Website or any product purchased through it, exceeding, in aggregate, the amount actually paid by you for the relevant order — except in cases of proven gross negligence or wilful default on our part, or as otherwise required under applicable Indian law.
14. Force Majeure
SimplyGods shall not be held responsible for any delay or failure to perform its obligations under these Terms where such delay or failure results from causes beyond its reasonable control, including natural disasters, pandemics, strikes, courier network disruptions, government restrictions, or supply chain shortages.
15. Indemnification
You agree to indemnify, defend, and hold harmless SimplyGods Global Private Limited, and our directors, officers, employees, and agents, from and against any claim or demand, including reasonable legal fees, made by any third party arising out of or relating to your breach of these Terms, your violation of any law, or your infringement of the rights of a third party.
16. Severability and Entire Agreement
16.1 If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be severed, and shall not affect the validity and enforceability of the remaining provisions.
16.2 These Terms, together with any policies or operating rules posted by us on the Website (including our Privacy Policy and Returns and Refunds Policy), constitute the entire agreement between you and SimplyGods and govern your use of the Website and purchase of our Products, superseding any prior agreements between you and us.
17. Termination and Survival
Obligations and liabilities incurred prior to the termination date shall survive termination for all purposes, including provisions relating to intellectual property, disclaimer of warranties, indemnification, and limitation of liability.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 19 (Grievance Redressal), any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
